The full federal appeals court is divided, five to five, so it will not rehear the case. The tie means Wisconsin can enforce its Voter ID law.
Opponents of the law insist it is unconstitutional and that thousands of people in Wisconsin could not obtain the proper identification in order to vote on November 4. Those parties asked the full court in Chicago to reconsider the decision a three judge panel reached. It ruled on September 12, that Wisconsin can require voters to present government-issued identification for the November election.
Friday morning's court decision did not explain the judges' opinions.
Those who favored rehearing the case were Judges David Hamilton, Richard Posner, Ilana Rovner, Claire Williams and Diane Wood.
